Automatic Acquisition of Italian Citizenship

A minor born abroad to Italian parents is an Italian citizen automatically if, at the moment of birth, one of the following occurs:

Case A1) Parent with exclusive Italian citizenship (Art. 3-bis, paragraph 1, letter c Law February 5, 1992, n. 91):

  • Child of an Italian parent who, at the time of the minor’s birth, held ONLY Italian citizenship. (required documentation)

Case A2) Grandparent with exclusive Italian citizenship (Art. 3-bis, paragraph 1, letter c Law February 5, 1992, n. 91):

  • One of the grandparents held ONLY Italian citizenship at the time of the grandchild’s birth or at the time of their own death (if it occurred earlier). (required documentation)

Case B) Parent who resided in Italy for at least two consecutive years before the birth of the minor (Art. 3-bis, paragraph 1, letter d Law February 5, 1992, n. 91):

  • Child of an Italian parent with multiple citizenships who lived in Italy for at least 2 continuous years, after the recognition of Italian citizenship and before the birth of the child. Residence prior to the acquisition of citizenship or the residence of the foreign parent is not considered. (required documentation)
