Case C) Minor not falling into the previous categories, but whose parent is an Italian citizen by birth “jure sanguinis” (Art. 4, paragraph 1-bis, letter b Law February 5, 1992, n. 91):
- At least one parent must be an Italian citizen by birth “jure sanguinis”. Parents who are Italian by naturalization, marriage, re-acquisition, law benefit, or “iuris communicatione” are excluded. (required documentation)
- Must be registered in “AIRE” and reside in the consular jurisdiction (link Fast-it).
- The “dichiarazione di volontà” (declaration of will) must be presented in person at the Consulate by 05/31/2029 by both parents before a “funzionario dello stato civile”.
- The minor becomes a citizen starting the day after the declaration (not from birth).
- As an adult, they can renounce citizenship if they possess another one.
MINORS UP TO 3 YEARS OLD
Declarations can be presented within 3 years of birth or the date “filiazione” (filiation/paternity) is established.
MINORS OVER 3 YEARS OLD
Must be a minor as of May 24, 2025, and be the child of a parent recognized as an Italian citizen “jure sanguinis” by March 27, 2025.
If the minor has since become an adult, they must present the declaration personally by May 31, 2029.
The Declaration must be made in person at the Consulate before a “funzionario dello stato civile” (civil status officer).
If the parents do not declare simultaneously, the date of the second parent’s declaration shall prevail.
If there is only one parent (or the other is deceased), the declaration of one is sufficient, provided there is documentary proof.
For law benefits, once the correctness of the documentation has been verified, interested parties must wait to be contacted by the “ufficio Stato civile” to schedule an appointment. The presence of the minor(s) is not required at the appointment.
ATTENTION
Starting January 1, 2026, the administrative fee of 250 euros for citizenship by law benefit is no longer required.
