{"id":520,"date":"2023-05-25T13:57:33","date_gmt":"2023-05-25T17:57:33","guid":{"rendered":"https:\/\/consboston.esteri.it\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/stato-civile\/trascrizione-nascita-di-figlio-minorenne\/"},"modified":"2026-04-17T09:10:57","modified_gmt":"2026-04-17T13:10:57","slug":"trascrizione-nascita-di-figlio-minorenne","status":"publish","type":"page","link":"https:\/\/consboston.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/stato-civile\/trascrizione-nascita-di-figlio-minorenne\/","title":{"rendered":"Registration of Birth of a Minor Child"},"content":{"rendered":"<p><strong>Mandatory Requirements<\/strong> Before registering the birth of a minor, the following <strong>must have already been registered<\/strong>:<\/p>\n<ul>\n<li>Marriage of the parents.<\/li>\n<li>Any previous divorce and marriage.<\/li>\n<li>The &#8220;Ufficio di Stato Civile&#8221; must be informed if the minor has been adopted, in order to ensure the correct registration and update of the records.<\/li>\n<\/ul>\n<p>A minor born abroad to an Italian citizen can be recognized as an Italian citizen if one of the following conditions applies:<\/p>\n<p><strong>Case A1) Parent with exclusive Italian citizenship:<\/strong> (Art. 3-bis, paragraph 1, letter c Law February 5, 1992, n. 91) (see &#8220;<a href=\"https:\/\/consboston.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/stato-civile\/trascrizione-nascita-di-figlio-minorenne\/acquisto-automatico-della-cittadinanza-italiana\/\">Automatic acquisition of Italian citizenship<\/a>&#8220;).<\/p>\n<p><strong>Case A2) Grandparent with exclusive Italian citizenship:<\/strong> (Art. 3-bis, paragraph 1, letter c Law February 5, 1992, n. 91) (see &#8220;<a href=\"https:\/\/consboston.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/stato-civile\/trascrizione-nascita-di-figlio-minorenne\/acquisto-automatico-della-cittadinanza-italiana\/\">Automatic acquisition of Italian citizenship<\/a>&#8220;).<\/p>\n<p><strong>Case B) Parent who resided in Italy for at least two consecutive years<\/strong> before the birth of the minor (Art. 3-bis, paragraph 1, letter d Law February 5, 1992, n. 91) (see &#8220;<a href=\"https:\/\/consboston.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/stato-civile\/trascrizione-nascita-di-figlio-minorenne\/acquisto-automatico-della-cittadinanza-italiana\/\">Automatic acquisition of Italian citizenship<\/a>&#8220;).<\/p>\n<p><strong>Case C) Minor not falling into the previous categories,<\/strong> but whose parent is an Italian citizen by birth (Art. 4, paragraph 1-bis, letter b Law February 5, 1992, n. 91) (see &#8220;<a href=\"https:\/\/consboston.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/stato-civile\/trascrizione-nascita-di-figlio-minorenne\/acquisto-della-cittadinanza-per-beneficio-di-legge\/\">Acquisition of Italian citizenship by law benefit<\/a>&#8220;).<\/p>\n<p>The regulatory changes introduced by &#8220;decreto-legge n. 36&#8221; of March 28, 2025 (converted by Law n. 74 of May 23, 2025) introduce important limitations on the transmission of Italian citizenship. They allow the recognition of Italian citizenship to a minor born abroad only if they fall into one of the categories listed above. These limitations also directly affect the &#8220;trascrizione&#8221; (registration) of birth certificates for minors born abroad to Italian citizens.<\/p>\n<p><strong>Practical Information<\/strong><\/p>\n<ul>\n<li>Certificates issued by the competent Italian &#8220;Comune&#8221; (last Municipality of residence in Italy or &#8220;AIRE&#8221; registration) must have a validity of no more than six months before the date of the request for birth registration.<\/li>\n<li>For certificates not formed within the consular jurisdiction of the &#8220;Consolato Generale d\u2019Italia di Boston&#8221;, it is recommended to always verify the correctness of the documentation with the competent Italian Consulate for that territory.<\/li>\n<\/ul>\n<p><strong>Birth Certificate &#8220;Long Form&#8221; (USA)<\/strong><\/p>\n<ul>\n<li>Request it from the Department of Health of the State of birth.<\/li>\n<li>It must report the city\/country of birth, parents, and dates of birth.<\/li>\n<li>Certificates listing only the county are not accepted.<\/li>\n<\/ul>\n<p><strong>&#8220;Apostille&#8221;<\/strong><\/p>\n<ul>\n<li>Must be requested from the Secretary of State of the State that issued the certificate (<a href=\"https:\/\/consboston.esteri.it\/wp-content\/uploads\/2023\/05\/infoapostilla.pdf\">informations<\/a>).<\/li>\n<li>The &#8220;apostille&#8221; does not need to be translated.<\/li>\n<\/ul>\n<p><strong>Translations<\/strong><\/p>\n<ul>\n<li>Must be integral, faithful, typewritten, and without unit conversions.<\/li>\n<li>The translation can be done by the applicant; if done by a translator, it must be appropriately notarized and &#8220;apostillata&#8221; (or legalized if the birth occurred outside the USA). A <a href=\"https:\/\/consboston.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/altri-servizi-2\/traduzione-e-legalizzazione-dei-documenti\/\">list of translators<\/a> is available on the Consulate website.<\/li>\n<\/ul>\n<p><strong>Surrogacy Notice:<\/strong><\/p>\n<ul>\n<li>Under Law n. 169\/2024, &#8220;surrogazione di maternit\u00e0&#8221; by Italian citizens is a crime prosecutable even if committed abroad.<\/li>\n<li>The consular authority receiving a suspicious birth certificate is obliged to report it to the competent Italian &#8220;Procura&#8221;.<\/li>\n<\/ul>\n<p><strong>N.B.<\/strong> Documentation for both automatic acquisition and law benefit must be sent in original <strong>EXCLUSIVELY BY MAIL<\/strong> to:<\/p>\n<p style=\"text-align: center;\"><strong>Consulate General of Italy in Boston<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>Ufficio di Stato Civile<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>600 Atlantic Avenue, Boston MA 02210<\/strong><\/p>\n<p>Due to the volume of requests, the office cannot confirm receipt.
